Legal Basis for KPD Registration Power of Attorney

In the official regulation stipulated in Article 9 paragraph (1) of the Minister of Social Affairs Regulation (Permensos) Number 2 of 2021 concerning Disability Cards, it is affirmed that:

"In the event that a Person with Disability is unable to register directly with the sub-district head or village head or other designated official... they may be assisted by social service officers or other individuals accompanied by a letter of assignment or power of attorney from the Person with Disability."

This regulation provides legal certainty that physical limitations should not be an obstacle for anyone to obtain their right to identity as a person with a disability. The offline registration process at the sub-district office is fully legitimate to be represented, provided that official delegation of authority documents are presented.

Who are the "Other Individuals" Legally Authorized to Represent the Applicant?

In accordance with the provisions of Article 9 paragraph (2) of Permensos Number 2 of 2021, parties permitted to assist or legally represent KPD applicants are limited to the following list to prevent misuse of personal data:

1. Family/Guardian: Blood relatives or legal guardians of the person with a disability.

2. Village or Sub-district Officials: Local administrative officers (RT, RW, hamlet head, or head of social services section in the sub-district/village).

3. Social Workers (Peksos): Professionals with competence in social welfare management.

4. Social Welfare Personnel (TKS): Volunteers or representatives of community social associations recognized by the Social Service.

5. Organizations for Persons with Disabilities (OPDIS): OPDIS administrators or disability community where the applicant is affiliated.

Required Documents for the Proxy Holder

When visiting the sub-district or village office to register for a KPD, the proxy holder must submit a document folder containing the following administrative files:

• Original Power of Attorney: A power of attorney with sufficient stamp duty, signed or thumb-printed by the person with a disability (as the grantor) and signed by the representative (proxy holder).

• Original Letter of Assignment (For Officials Only): If represented by a Social Worker, TKS, village official, or OPDIS administrator, they must bring an official Letter of Assignment from their respective institution or organization.

• KPD Registration Form I: The official registration form filled out using block letters (capital) and black ink.

• Photocopies of Population Documents: Consisting of photocopies of the ID card (KTP) and Family Card (KK) belonging to the person with a disability (applicant), as well as a photocopy of the proxy holder's ID card (KTP).

Technical Guide for Correct KPD Power of Attorney Writing

To ensure your power of attorney is immediately accepted by sub-district officials without document correction issues, ensure the power of attorney format includes the following key information elements:

1. Grantor's Identity: Include the full name (without academic/religious titles), NIK, KK number, and complete address of the disability rights holder as per their ID card (KTP).

2. Proxy Holder's Identity: Include the full name, NIK, address, occupation, and relationship of the proxy holder to the grantor (e.g., Biological Child, OPDIS Administrator, Social Worker).

3. Specific Purpose of Power: Clearly state that this letter is made "Specifically to represent the offline registration and processing of Disability Card (KPD) documents at the Sub-district/Village Office."

4. Signature and Endorsement: The letter must be affixed with a signature over a Rp10,000 stamp duty or a thumbprint of the grantor (if the applicant has hand motor skill limitations), as well as the signature of the proxy holder.

Solutions If the Sub-district Office Refuses Registration by Proxy

Field observations indicate that sometimes there are still sub-district or village officials who are not yet familiar with Permensos 2/2021, leading them to insist on refusing proxy registrations. • Report to the National Commission on Disabilities (KND): The KND is tasked with monitoring and advocating for the fulfillment of disability rights, and you can write to this institution to request mediation assistance.
